A 2 point violation ticket does not always need to be fatal. For example speeds over 20 mph over the speed limit, traveling on a roadway in the wrong direction etc can be worked out. Many times a plea can be worked out with the district attorney to convert the ticket into two separate violations. For example one can be a basic speed law violation and wiped off the record through traffic school and the other violation can be a very inexpensive non moving violation such as coasting etc. In this situation the court will not negotiate a ticket, but the DA will.

How this works. Whenever a court trial (the only way to renegotiate a ticket) is scheduled and there is no attorney of record it is merely set with the driver and the officer present. Now the officer may agree with a modification but a better approach exists. With an attorney the matter is set on the attorney calendar and then a DA is present to represent the officer. At the same time many fines can be negotiated down. All paperwork is mailed back to the client timely. All legal matters can be set at a flat rate with a payment plan if necessary.

The important thing to remember when being issue a traffic ticket is not only the points connected with it, but if found guilty insurance premiums increase for three years. After two points fines double and insurance rates follow as well. When four points are reached the DMV can suspend the drivers license and the insurance company can drop the policy.

Appeals
The Law Firm of Holden Green handles traffic appeals (30 days from date of decision) and DUI appeals. Under DUI appeals, a driver can appeal to the DMV in Sacramento (however license is still suspended) or directly to Court under a Writ of Mandamus. In this case, a judge can sign an order stating the suspension pending the outcome of the appeal before a local judge of that county.

The Power of the Subpoena
One of the unique yet extremely useful tools of the Law Offices of Holden Green uses when addressing traffic tickets is a Subpoena Duces Tecum. Essentially the officer must bring everything to the court that is on the list. The law office usually requests the lidar/radar equipment physically into court among other relevant items/statements to be used in presenting a defense in court. Many times the officer cannot gather all the records quick enough. For that reason the case either gets dismissed (for lack of evidence) or amended to a much lesser charge even a no point violation. Another useful tool is to ask for a speedy trial or have the ticket heard within 45 days of arraignment. This also puts pressure on the officer to either produce or dismiss. For criminal matters the result is the same. Rather than serving the requested materials from the police officer, it is instead served upon the office of the district attorney. Commercial Drivers
Many times commercial drivers cannot get any points or no more than one. Commercial drivers are not eligible for traffic school due the nature of holding a class A or B license. To keep driving and stay employed the driver must have the best driving record possible. Many employers will not allow a driver to have more than a point and certainly no more than two. The best way to negotiate out of point issue is to hire an attorney. Under this process the law office has in the past converted a ticket into a non point violation. Many times the DA is aware of the problem with points so if the violation is mainly routine then the odds of an acceptable resolution increases. Many fines can also be negotiated down. All cases can be agreed to with a flat rate and if needed a payment plan. Often times the driver does not need to be present and this is a great circumstance if there are out of state or the area issues.
